This isn't factually correct, just to let you know. The onus is on the officer to not put himself in danger and to evade. That's a simple fact backed and evidenced by experts.

 

Now, in terms of him getting away with it, that's another matter entirely. But in terms of law and procedure he was in the wrong. He stepped in front of the vehicle and evaded while firing.

And the fact is he would have ended up exactly like he did if he didn't grab his gun and kill her - unharmed. It changed nothing except killed someone.
