nine Posted June 7, 2025 Report Share Posted June 7, 2025 Had Garcia been afforded due process 2-3 months ago, he could have already had a quick hearing and been deported and it’s a complete non-story. But instead, the federal government paid to have him extradited back to the US to stand trial. Now they’re paying the cost of a criminal trial and the cost of keeping him incarcerated until the trial’s conclusion, after which he’ll almost certainly be deported. These additional expenses could have been easily avoided. All the government had to do was follow the United States’ long-established legal processes and procedures in the first place. But instead, the administration chose to thumb their nose at the law, the Constitution, and the judicial system. Now they’re having to pay twice to have the guy deported. Don't forget the cost of an appeal, should he be convicted, and the cost of him being held in a BOP facility. I've represented plenty of clients here illegally on appeal and at trial in Texas, and those that received lengthy prison sentences are still in the custody of TDCJ until they finish that sentence or get paroled. But this assumes the administration will respect Garcia’s right to file an appeal….which is highly unlikely, based on their past handling of such matters. The minute they have a conviction, they’ll have him on the next flight out of the country so they can once again loudly proclaim a WIN for deporting a convicted criminal who was here illegally. As far as the constitutional right to due process and his right to an appeal… ”Fuck you, fuck the law, and fuck the Constitution. We do as we like….and you won’t do shit about it.” And they’re right.
