She has to be actively and intentionally working with our enemies. What Romney said was discussing the essence of treason and not the law. He was talking about the spirit and understanding of knowingly helping our enemies. I think there should be repercussions for her actions, but her 1st Amendment Rights are a block against such unless it is proven she is knowingly being directed to say and do such things by an enemy or foreign agent.
