OzTitan
Just now, Titandan said: The contrast is in the way I treated a tenant vs a random trespasser. Sorry. I'm back to my old essay writing ways. But it's interesting how this happened just today. And for the sake of the "offending party" I would also hear his side of the story before making final "judgement." I do not like this part of the job... actually seriously hate dealing with difficult people. But I do try to be fair and use reason. I would have no energy and lack empathy for a random stranger who came into our living arrangement. This is not because I hate people and I like to be a dick. I have to protect those whom I have an obligation to provide housing. Seriously not looking forward to addressing tonight's events with the other girl who's giving me attitude these days. Even the "victim" was astounded by her attitude today. Only girl I take that from on occasion is my girlfriend or my mother. Fuck everyone else... no patience for that. Right okay, but I mean, a random trespasser is easy for you to identify because you have a comparatively small amount of tenants. The better comparison here is not what you'd do once you've identified a trespasser because that isn't what we're talking about. It's what you'd do if you had no idea if they were a trespasser or not. If you weren't sure if the offender was a signed tenant or not, presumably you'd first undergo some sort of process to determine that. Ideally one that is fool proof and not prone to making mistakes and misidentifying tenants as trespassers. Obviously it is probably not a strenuous task for you to do that, so the analogy falls down a bit there, but let's say it was quite difficult for you to do this - you'd still have to do it, right? suck it up and just get on with it. Because the alternative is probably not acceptable for you. And it shouldn't be, if you're a good landlord. So you see, the trespasser is given due process if you want a fair and reasonable system. OzTitan
5 minutes ago, Titandan said: To me the principle stays the same whether it's a house with 4 rooms being rented out or a mega-apartment with 400 units. To mitigate the possibility of the tenants that might be harassed by creepers or extorted by neighborhood gangsters, I would hire security in the lobby and make sure I have a fool proof system of multiple background checks to make sure I don't lease out to potential tenants with record of violence and/or serious psychological issues. I would have to have multiple ways of making sure no creepers will get through security and in the case that they do and there is an incident, I will make sure that the tenants are okay first and the trespasser is immobilized, in containment, or at least kicked out while the authorities are notified. Due process could be held by the city/county court but within my apartment complex, expel him/her and then ask questions later. The trespassers are not my responsibility and my obligation is to my tenants, period. They pay good money to stay in a safe environment and I have an agreement/responsibility to make sure they will be prioritized. I'm not saying I'm right and you're objectively wrong if you think differently. I just choose to think this way because this is what I value. You can choose to value something else. We can agree to disagree. But you just posted about how your process is different if it involves two tenants. What I'm saying is, in situations where you don't know whether a person was a tenant or not, you would first find out, wouldn't you? in your post describing the happenings of your day, if you had no idea if the person being creepy was a tenant of yours, you'd have found out before deciding on what to do, wouldn't you? You say expel him/her and ask questions later, but that flies directly in the face of the real world example you gave a few posts back. You knew the person was a tenant of yours, but if for some reason you didn't and for some reason it was not easy for you to know the identity of any of your tenants, presumably you'd have invested effort in finding that out early on in the process. That is the due process in your analogy. It's not a great analogy for a country and handling immigration matters, because the complexities involved are not comparable, but that is the analogy to make. OzTitan
36 minutes ago, Titandan said: My post was comparing how I treat my tenants (even the harassing dude) vs how I would hypothetically treat a trespasser or even a friend of one of the tenants. I have an obligation to prioritize my tenants. For example, we have limited parking on the driveway at the same property. We have to fit the cars like Tetris blocks when majority of the guests bring cars. Six spots. I have mentioned more than a handful of times that if the tenants invite friends, the friends cannot park in our driveway unless it's a pick up/drop off type situation. I'm trying to maintain a free parking policy reserved for tenants. But it only works when tenants are considerate. This one time, one of our tenants and his friend ended up parking his friend's car on our driveway and they Uber-ed to a movie premier. I texted on group chat asking who's car that was because our other tenants couldn't park. I waited about 3 hours, the other tenants were waiting to park their cars, and it was getting late so I was about to call the towing company. There was no street parking that night because the next day was street sweeping day (8am-11am no parking). So as I was about to call the towing company, the tenant finally texts us back on group chat saying it's his friend's car and they will be back at almost 12am. I had to wait with two of the other guests at 12am and wake another tenant up so that she can remove her car so that this inconsiderate tenant can get his friend's car out of the driveway that they had no business parking at. My last example may seem like a minor inconvenience but you'd be surprised how pissed people can get with minor things (myself included). I stand by my principle of putting my tenants first and everyone else second (if at all). The other tenants who had to wait until 12am were pissed/disappointed as was I that this uninvited person parked her car in a spot she had no business parking at (and also at the tenant who allowed his friend to park there while inconveniencing the rest of the roommates). I have no obligation to provide this service to someone I don't know (even a friend of one of the tenants) and rather, it pissed me off that inconsiderate behavior wasted a bunch of other people's time. If there's a pattern of inconsiderate behavior amongst the tenants, I might have to go with the paid parking route. Anyway, it's a matter of priority. I don't believe illegals should be afforded the same rights in the United States. They should be sent back to their country of origin and if they committed crimes, it should be their country of origin's responsibility. The fact that he's residing here when he's not legally allowed to is a crime in my book. Yes, I know people who are illegal. Yes, I work with some of them. But the principle does not change. What they are doing is illegal. It's out of control here in LA so we accept it as a part of our culture now but the system is screwed up. Just because I learned to live with it doesn't mean it's right. Look, I'm clearly not getting through. I'm not even sure if you were making an analogy now or are just wanting to talk about your business. The questions in my previous post remain if you want to answer them directly, otherwise this is sort of losing its focus. IsntLifeFunny

Jamalisms
Dan stopped arguing whether or not it was legal long ago. Arguing we should break the law to punish people for breaking the law really isn't worth a response. Did you guys hear about Trump's proposal to not tax the middle class ($150k and under bracket)? I assume most of us on this board would qualify and that's good.
