The phrase "a prosecutor could persuade a grand jury to indict a ham sandwich" means that grand juries almost always agree with prosecutors, easily returning indictments because they only hear one side (the prosecution's) and need only find probable cause, not guilt, making the system a rubber stamp for charges, as famously stated by former NY Judge Sol Wachtler.

The grand jury also failed to indict Andrew McCabe in Trump's first term. Trump also fired McCabe a day before he was set to get his pension. Of course McCabe sued and won his pensions and benefits back. 

 

These weaponizing of the DOJ by Trump should be massive scandals resulting in removal from office but for Trump it's just another day as president.

Statistically, Comey will be indicted eventually if they just keep trying. At some point you have to have the stars align. 

 

Of course, then they have to go to trial and it all dies there; probably gets thrown out for obvious reasons. But an indictment is theoretically possible if they never stop trying.
