nine Posted March 1, 2024 Report Share Posted March 1, 2024 In additional to Thomas' potential conflict of interest, three other justices (Gorsuch, Kavanaugh, Coney-Barrett) were originally nominated by Donald Trump....and will now be asked to rule whether the very President who nominated them had immunity for his actions while in office. While this doesn't automatically make them biased...it could certainly give people reason to question their impartiality. Judicial standards do not differentiate between the potential or appearance of bias and actual bias; they're one and the same. In the American justice system, a judge or justice with a personal or financial connection to a case is typically expected to recuse themselves in order to maintain the court's appearance of impartiality. However, as the nation's highest and final court, SCOTUS has no appellate court or overseeing body to review or determine when recusal is appropriate; each justice is trusted to judge his/her own ability to remain impartial and determine whether their participation could suggest an appearance of bias. It's highly unlikely that the four justices with a personal association to to Donald Trump would recuse themselves from the case. The question is.....will any of them choose to do so? The outcome of the case is pretty predictable. But it is going to delay the DC trial and they are fine with doing that for him. BTW, if SCOTUS did rule for Trump that presidents have legal immunity, Biden should have all of the justices who ruled for Trump summarily executed. Kimberly Zapata, 47, was charged in November of that year with one felony count of misconduct in public office and three misdemeanor counts of election fraud. The jury found her guilty of all four counts Wednesday, The Associated Press reported. ….In October of 2022, Zapata served as the deputy director at the Milwaukee Election Commission. She used her work-issued laptop to get three military absentee ballots using fake names and Social Security numbers. As part of her job, she oversaw the counting of absentee ballots in Milwaukee. Zapata had the extra ballots sent to the home of state Rep. Janel Brandtjen (R), who chairs the Assembly elections committee and has voiced support for overturning the 2020 presidential election results.
