Kushner facing 5 years for lying on White House Security Clearance

Jared Kushner signed form SF86 for Security Clearance when he became Trump's official White House advisor. The form is 127 pages long and asks for very detailed and specific information. 

Page 2 of Form SF86 has the following warning in bold

“The U.S. Criminal Code (title 18, section 1001) provides that knowingly falsifying or concealing a material fact is a felony which may result in fines and/or up to five (5) years imprisonment. In addition, Federal agencies generally fire, do not grant a security clearance, or disqualify individuals who have materially and deliberately falsified these forms, and this remains a part of the permanent record for future placements.”

In that form, on page 59, the question is asked, "Do you have or have you had close and/or continuing contact with a foreign national within the last 7 years with whom you or your spouse are bound by affection, influence, common interest and/or obligation? Include ALL associates and/or relatives. A foreign national is defined as any person who is not a citizen or national of the United States.

Jared Kushner failed to document the meeting with the Russian Nationals regarding the highly sensitive and potentially damaging information on Hillary Clinton being made available to the Trump administration. Jared Kushner will be questioned by the Senate Intelligence committee and by Robert Mueller regarding this meeting. He will either perjure himself or admit to committing a felony. Jared is in some deep shit.

The emails with Donald Trump Jr. about the Russian meeting were discovered as Kushner and his legal team prepared for his testimony before Congress as they were doing a document review, a source familiar with the process told CNN.

As soon as the document was discovered, Kushner's disclosure form was amended to include the meeting, the source said.

This means that Kushner's SF-86 changed a number of times: First, the inaccurate form, which left blank the foreign contacts section. Next (and the next day), the form was amended to say that he had multiple contacts and would disclose those. The process of gathering information progressed throughout the winter and spring. Then the form was amended yet again to include the Trump Jr. meeting as soon as it was discovered, a source with knowledge of the process told CNN.

On Saturday, Kushner's attorney Jamie Gorelick gave this statement: "As we have previously stated, Mr. Kushner's SF-86 was prematurely submitted and, among other errors, did not list any contacts with foreign government officials. The next day, Mr. Kushner submitted supplemental information stating that he had had "numerous contacts with foreign officials" about which he would be happy to provide additional information. He has since submitted this information, including that during the campaign and transition, he had over 100 calls or meetings with representatives of more than 20 countries, most of which were during transition. Mr. Kushner has submitted additional updates and included, out of an abundance of caution, this meeting with a Russian person, which he briefly attended at the request of his brother-in-law, Donald Trump Jr. As Mr. Kushner has consistently stated, he is eager to cooperate and share what he knows."

Yes, it's true that you can be prosecuted for this but honestly I don't think i've actually seen anyone prosecuted for lying on one.  I would be incredibly surprised if they actually go after him for this.  

Still, one more thing that damages any credibility he may have once had.  

One would think White House security clearance would be scrutinized pretty thoroughly due to the amount of classified info they are privy to. It wouldn't surprise me if Kushner left that page blank intentionally with the plan of saying "Oh, I forgot to fill that out' as they are basically doing now.

Ben, you're glossing over the fact that the email said JR was agreeing to a meeting with "The Russian government attorney". He went to the meeting under the impression that he was going to be working with someone from the Russian government to help his fathers campaign. Kushner was invited to the meeting and it's very unlikely he went into this meeting blind to who he thought he was meeting. But he certainly knew after the fact that he met with someone from Russia, to which he neglected to mention. 

I will say though that Kushner has a better chance at pleading ignorance in this scenario than does JR. JR set the whole thing up and knew what he was getting into. 

 

Also, the more I read that email, I seriously think Goldstone was setting them up for blackmail. On whose behalf though?

How much you wanna bet he didn't violate anything by not putting it down.  Have you ever seen an SF86 form?  No one has said that he has.  It's all wishful conjecture.  You know, fake news.

wtf are you talking about? Kushner's lawyer said the original SF86 was inaccurate and didn't disclose contacts with foreign government officials. They've already admitted it. The facts aren't up for debate. The only question is if they'll go after him for it.

In all fairness, it is always best (e.g. a really good fucking idea) to err on the side of caution when filling out an SF86, and to disclose more than is being asked for rather than less.

The SF86 is concerned about giving aid to or having financial and/or other binding relationships with foreign countries and foreign nationals, and with meetings that took place on foreign soil.

The meetings he had with the Russians probably did not fall under any of those categories.

However, his lawyer probably recommended he err on the side of caution, as I mentioned above.  Hence, the update.
