I’m certainly no lawyer…but it’s my understanding that attorney-client privilege does not apply in cases where both parties were complicit in illegal activity. Trump is returning to New York after appearing last week in Manhattan for his arraignment on 34 felony counts from the local district attorney related to hush money paid to an adult film star shortly before the 2016 election. The former president has denied any wrongdoing. In the separate lawsuit from James, the state attorney general alleges Trump, along with his three adult children and his business entities, manipulated property values to obtain investments and loan benefits over numerous years. Trump previously appeared for his first deposition in the civil fraud case last August; he did not answer anything but procedural questions, invoking the Fifth Amendment more than 400 times. The hardest part on that front will be proving intent. If Trump is good at anything it's keeping layers between him and accountability. He does seem to have slipped a bit though, which isn't surprising given his ego after attaining what he believed to be lifetime immunity. It'll definitely be interesting to watch unfold. It might depend on what happened to the money all the suckers sent in. But we know that it didn’t go into the legal effort to overturn the election. They would need to account for it.
