I guess the #1 best option for the country would be if a deal is worked out where he avoids prosecution and resigns. That seems like pie in the sky right now, but who knows? Not really. First of all I'm not suggesting what anyone "should" do. Heitkamp seems to have voted her morals and conscience ant that is to be applauded. Second I doubt she had a chance to keep that seat anyway and/or doubt you can draw a straight line between that vote and her loss. She barely won it to begin with.
