But one huge consideration: it’s my understanding that the protection of executive privilege and attorney/client privilege does not extend to illegal or unlawful activity. If the prosecution can demonstrate that what Trump and/or his legal counsel were doing was illegal….then any meetings, conversations, and/or electronic communications related to said activities would become admissible. That's the point of the RICO charge. They have to establish the criminal enterprise then they just need to prove that ANY member of that enterprise committed an overt act towards their corrupt goal. ie they need to prove Trump is a part of the criminal organization. They do not need to connect him directly to that overt act. It's why RICO is used against mob bosses. And Fani Willis apparently has a history of getting convictions with RICO charges. She's somewhat of an expert in that realm. So connect Trump to the organization and then prove someone in that organization made a move towards their corrupt goal. It's my understanding that in a RICO conspiracy, that each conspirator can be changed with anything that any of the others have done.
