Titanjuicy
Cory Booker acknowledged that he violated Senate rules. He released an email this morning during the SCOTUS hearing with confidential (maybe classified) info on Kavanaugh. The Senator from Hawaii promptly followed. This could result in the removal of Booker from the Senate. He went a step further and doubled down daring them to bring charges on him and even told the Republican Senator from Texas to "Bring it." Very ballsy move by Booker. If you have followed the back story of this, you know why Booker, and other Democratic Senators, back him. Right or wrong, very gutsy move. That my friend is a leader for the American people. MOD EDIT: Documents had been cleared for release. ctm
oldschool
Cornyn was out of line. The dispute over whether committee confidential docs fall under the senate rule Cornyn referenced is a huge stretch.

(I'd go so far to say they're nothingburgers). It's very obvious that he's running for President in 2020. There's far too much political theater during this Kavanaugh hearing. Unnecessary for the administration to hold back so many documents, and unnecessary for some of these Democrats to make such a show out of what we've seen so far (unless there's more). I'm disheartened by so many Democrats who are saying that they need to get their hands dirty. What happened to "when they go low, we go high?". I think this is the wrong tactic. It may excite the base, but it animates (and solidifies) their opposition and alienates independents and moderates. Justafan, and Soxcat
9 Nines
The releasing the emails was done for two points 1) show Kavanaugh's legal views on the subject and 2) show the games that the Republicans are playing by claiming this had to do with national security (it was a related security subject but the legal discussion had nothing to do with national security.) reo

What they should be doing is pointing out elections have consequences and telling everyone who claims to be a democrat to get off their asses and vote because not doing so led to a Trump presidency and a conservative Supreme court. I'd use Gorchich and Kavanaugh every chance I could as a democrat operative. Make sure the voters understand the implications of staying home. One of the emails says in effect that Roe v. Wade can be overturned. That's far from nothing. Republicans are withholding hundreds of thousands of documents from his time in the white house. What are they supposed to do....roll over. OILERMAN, Starkiller, and pat

But the legal views are so mainstream and entirely defensible that they don't amount to much. Kavanaugh stating that "he's not sure all legal scholars believe that Roe is settled law" is 100% true. Within the context of proof-reading an article, it's a stretch to think that he wouldn't respect precedence in-so-far as the original ruling. The rest of the emails are even less controversial. I'm not sure how I feel about Ben Sasse, but he did write an insightful article in the WSJ about the impotency of Congress has lead to the public (and political parties) to treat the Supreme Court like "super legislators" who can break through the gridlock and address the public's grievances. He goes on to correctly point out that this is not the original or appropriate role of the Supreme Court. I completely agree with that sentiment - and the solution is to fix Congress so it can be an effective and accountable legislative body. I don't think the grand-standing and political theater by either political party is helping in that respect.

The court has upheld Roe for decades. Of course there will some conservative scholar who disagrees. You can probably find some legal scholar to say just about anything. What matters is the Court. Exposing documents that the GOP is trying to hide shouldn’t negatively animate anyone in the middle, IMO. reo, and Mythos27

Republicans are withholding hundreds of thousands of documents from his time in the white house. What are they supposed to do....roll over. Many people do feel that Roe can be overturned, but that doesn't mean it will, and it doesn't mean that Kavanaugh would be an active proponent in achieving that goal. That's the difference. Nothing he said in that email was remotely controversial, especially for a conservative judge. In this case, the Democrats lost the election and while I 100% disagree with blocking Obama's appointee (and think it was shameful), the Democrats are outnumbered here. Kavanaugh, despite the hand wringing by Democrats, is not a dangerous judge. He wouldn't be dependable was a "super-legislator" (as Sasse puts it), but he's not dangerous. Democrats need to take their medicine on this issue and stop acting like they can find an out through the obstructing the process. They need to motivate their base to actually vote and prepare a coherent message for the mid-term elections. I don't understand why the Democrats are so willing to sacrifice so much for lost causes. (and conversely, do so little when it comes to actually voting). oldschool
