Trump Foundation will be defending itself in a New York courtroom shortly before this fall’s midterm elections. The proceedings seem unlikely to go well for the institution and its leadership; President Trump and his elder children, Ivanka, Donald, Jr., and Eric, are being sued by New York’s attorney general, Barbara Underwood, for using the charity to enrich and benefit the Trump family. On Tuesday, the judge in the case, Saliann Scarpulla, made a series of comments and rulings from the bench that hinted—well, all but screamed—that she believes the Trump family has done some very bad things. During Tuesday’s hearing, the Trump Foundation’s lawyer, Alan Futerfas, asked that the trial not commence in October, because it was so close to the midterms. Judge Scarpulla laughed in response, did not change the trial date, and hinted that she is likely to require the President to testify. A series of subpoenaed e-mails and a fascinating deposition offer a glimpse into the work of a mysterious figure, Allen Weisselberg, who has handled Donald Trump’s finances for as long as he’s had any. First hired by the President’s father, Fred Trump, Weisselberg has been the one steady presence in the Trump Organization for the entire period that Donald Trump has run the company. Weisselberg’s testimony in the trial, then, could prove revealing. He is perhaps the only non-family member who knows the inner workings of the Trump Organization. Michael Cohen will be a key figure in understanding Trump’s recent business relationships with several overseas partners suspected of potentially engaging in money laundering, corruption, and sanctions violations. (A federal criminal investigation of Cohen includes more than four million business files that will soon be turned over to investigators and are likely to shed light on the company’s operations during the ten years that Cohen was involved.) But it is only Weisselberg who can recount the essence of the Trump Organization from the beginning of Donald Trump’s involvement: in the nineteen-seventies, when the company first discriminated against African-Americans; in the eighties, when Trump appears to have been in business with the New York mafia; in the nineties, when Trump’s casino was in violation of anti-money-laundering laws; and through the aughts, as Trump developed ties to many Russian and former-Soviet oligarchs and political figures. The Trump Foundation case may have already revealed a potential rift between Weisselberg and the family. His deposition in the case is fascinating reading. Weisselberg makes it quite clear just how sloppy an operation the foundation was, with no meetings and no careful accounting. In a compelling exchange, Weisselberg describes how he flew to Iowa with a checkbook to give money to political allies of Trump, then a Presidential candidate, and he makes it clear that he did this because his boss told him to. After law school, Justice Scarpulla became Principal Court Attorney to the Hon. Alvin F. Klein. Justice Scarpulla then worked at Proskauer Rose Goetz & Mendelsohn as a litigation associate from 1988 to 1993. At Proskauer, she gained extensive experience in commercial litigation, accountants’ liability, securities regulations, real estate, contracts and commercial torts. In 1993, Justice Scarpulla joined the Federal Deposit Insurance Corporation as Senior Counsel in the New York Legal Services Office. While there, she represented the FDIC as receiver for numerous failed banks and litigated cases on banking and commercial issues, including ERISA and FIRREA. Justice Scarpulla then became Senior Vice Present and Bank Counsel to Hudson United Bank, where she was responsible for all litigation involving the bank, and also oversaw the banks’ compliance with state and federal banking regulations. Justice Scarpulla returned to the New York State court system in 1999, as Principal Court Attorney to the Hon. Eileen Bransten. She was elected to the Civil Court in 2001. While in Civil Court Justice Scarpulla presided over civil, commercial landlord-tenant, no-fault, pro se and small claims actions. In 2009, Justice Scarpulla was appointed an Acting Justice of the Supreme Court, and initially presided over a City Part, handling civil litigation involving the City of New York as a party. Justice Scarpulla was then assigned to an IAS Part, in which she handled a wide variety of civil cases. Justice Scarpulla was elected to the Supreme Court in 2012, and was assigned to an IAS part with an emphasis on complex asbestos litigation. In addition to her asbestos caseload, Justice Scarpulla handled construction injury/property damage cases, insurance coverage cases and general commercial litigation. Justice Scarpulla also presided over actions commenced pursuant to Mental Hygiene Law Article 9. Justice Scarpulla was assigned to the Commercial Division in February 2014. Justice Scarpulla is a member of the Association of the Bar of the City of New York, Catholic Lawyers Guild, Columbian Lawyers Association, Jewish Lawyers Guild, Judges and Lawyers Breast Cancer Alert, the National Association of Italian American Women, the National Association of Women Judges, the New York County Lawyer Association, the New York State Bar Association and the New York Women’s Bar Association. Justice Scarpulla is also a frequent lecturer at the Judicial Institute*. *The Institute provides a forum for identification of new and emerging legal, technological, social, criminal, and administrative trends affecting the courts; continuing education through courses, seminars, and conferences; advanced study of how interdisciplinary influences, such as technology, medicine, ethics, and social sciences, affect the law and the judicial process; and participation in cooperative education programs involving other branches of government, as well as other state and federal judicial systems. The rest of the case against Trump would continue, drawing the president into yet another legal battle in the months leading up to the mid-term election in November. The judge set a court date of Oct. 11 for remaining claims against Trump. Futerfas said he was unsure whether Trump will assert, as he has in other lawsuits, that he is immune from the claims. "We’ve laid out all the facts in the petition," Assistant Attorney General Yael Fuchs told the judge. The case will show a "willful disregard of relevant law," she said.
